DevBears ("we," "us," or "our") built the Mushroom Identifier: FungiSnap app (the "App") as a commercial application. This Privacy Policy explains how we collect, use, and protect information when you use our App.

1. Information We Collect

We do not collect, store, or transmit any personal information to our own servers. The App does not require user registration, and we do not maintain any user databases.

However, certain third-party services integrated into the App may collect information automatically, as described below.

2. Camera and Photo Access

The App requires access to your device's camera and photo library to provide mushroom identification features. Here is how we handle your photos:

Camera Access: The App uses your camera to capture images of mushrooms for identification purposes only.
Photo Library Access: You may also select existing photos from your device's photo library for identification.
Image Processing: Photos you submit for identification may be sent to third-party AI services for analysis. These images are used solely for the purpose of providing identification results and are not stored permanently on external servers.
Local Storage: Identification history and results are stored locally on your device and are not transmitted to our servers.

We do not use your photos for any purpose other than mushroom identification. We do not sell, share, or use your images for advertising or marketing purposes.

3. Third-Party Services

3.1 Google AdMob & Google AdSense

We use Google AdMob and Google AdSense to display advertisements within the App. These services may automatically collect certain information, including but not limited to:

Device identifiers (e.g., Advertising ID)
IP address
Device information (model, operating system, version)
App usage data and interaction with ads
Approximate location (based on IP address)

3.2 In-App Purchases

The App offers in-app purchases processed through Google Play Store and Apple App Store. We do not directly collect or have access to your payment information. All payment transactions are handled entirely by Google or Apple under their respective privacy policies:

The App uses third-party AI services to analyze mushroom images and provide identification results. When you submit a photo for identification:

The image is transmitted to the AI service provider for analysis.
The AI service processes the image to generate identification results.
We do not retain or store your images on external servers beyond the time needed for processing.

Disclaimer: The identification results provided by the App are for informational and educational purposes only. They should not be used as the sole basis for determining whether a mushroom is safe to consume. Always consult a qualified mycologist or expert before consuming any wild mushroom.

4. Ad Personalization & Your Choices

You can opt out of personalized advertising by adjusting your device settings:

Android: Go to Settings > Google > Ads > Opt out of Ads Personalization
iOS: Go to Settings > Privacy & Security > Tracking > disable "Allow Apps to Request to Track"

5. Children's Privacy

Our App is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided personal information through the App, please contact us so we can take appropriate action.

6. Data Security

Since we do not collect or store personal data on our servers, there is no user data at risk on our end. Photos submitted for identification are processed in real-time and are not permanently stored. However, we encourage you to review the privacy practices of the third-party services mentioned above.

7. Links to Other Sites

The App may contain links to external websites or services that are not operated by us. We have no control over and assume no responsibility for the content or privacy practices of any third-party sites or services.

Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Mushroom Identifier: FungiSnap app (the "App") operated by DevBears ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you have read, understood, and agree to these Terms. If you do not agree with any part of these Terms, you must not use the App.

2. Description of Service

The App provides AI-powered mushroom identification features using your device's camera or photo library. The App may include both free and premium features accessible through in-app purchases.

Important Disclaimer: The identification results are for informational and educational purposes only. They must not be used as the sole basis for determining whether a mushroom is safe to consume. We are not responsible for any harm resulting from reliance on the App's identification results. Always consult a qualified mycologist or expert before consuming any wild mushroom.

3. In-App Purchases & Subscriptions

3.1 Purchase Terms

The App offers in-app purchases, including but not limited to premium feature unlocks and subscription plans. All purchases are processed through the Google Play Store or Apple App Store (collectively, the "Store").

By making a purchase, you agree to the pricing and payment terms as displayed at the time of purchase.
All prices are subject to change. Price changes will not affect active subscription periods that have already been paid for.
You are responsible for any applicable taxes associated with your purchases.

3.2 Subscriptions

If the App offers subscription-based features:

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period.
Your Store account will be charged for renewal within 24 hours prior to the end of the current billing period.
You can manage and cancel subscriptions through your Store account settings.
Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

3.3 Refunds

All purchases are final and non-refundable, except as required by applicable law or the refund policies of Google Play or Apple App Store:

Google Play: You may request a refund within 48 hours of purchase through Google Play. After 48 hours, refund requests are handled at Google's discretion. See Google Play Refund Policy.

4. User Obligations

When using the App, you agree to:

Use the App only for lawful purposes and in accordance with these Terms.
Not attempt to reverse engineer, decompile, or disassemble the App.
Not use the App to transmit any harmful, offensive, or illegal content.
Not circumvent or attempt to circumvent any security features or access controls of the App.
Not use the App for any commercial purposes without our prior written consent.

5. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, and software, are the property of DevBears and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

6. Advertisements

The App may display advertisements provided by third-party ad networks, including Google AdMob. By using the App, you acknowledge and agree that:

Advertisements may be displayed within the App.
The content and accuracy of advertisements are the sole responsibility of the advertiser.
We are not responsible for any products or services advertised within the App.

7. Limitation of Liability

To the fullest extent permitted by applicable law:

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.
We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
Our total liability shall not exceed the amount you have paid to us through in-app purchases in the 12 months preceding the claim.
We expressly disclaim any liability for harm, illness, or injury resulting from reliance on mushroom identification results provided by the App.

8. Indemnification

You agree to indemnify and hold harmless DevBears from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

9. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us. Upon termination, your right to use the App will immediately cease.

10. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Korea.
